    Mediation is the most effective and non-adversarial tool for dispute resolution. We understand the need to be hard on problems and not on parties.

    The standing and credibility of this process in India has been exponentially elevated after the country has recently signed the United Nations Convention on International Settlement Agreements Resulting from Mediation, 2019 (Singapore Convention), w.e.f August 07, 2019, among other 46 countries in the world. As per the convention, the private mediation settlements can now be legally enforced in all these countries.

    Mediation has many benefits as compared to litigation

    Fast

    Mediation can occur relatively quickly in the dispute since the time required for mediation is generally much less than that needed for a court trial. This also helps the mediator concentrate on just the relevant issues and ignore
    peripheral matters.

    Cost Effective

    Because mediation is less formal and complex than litigation, it generally requires little to less preparation and is always less expensive
    compared to a trial.

    Can Protect Relationships

    Order 32A of the Code of Civil Procedure recommends mediation for familial/personal relationships.

    • Finalize pre-mediation individual calls/meetings, mediation dates, attendees, venue, etc.
    • Arrange position papers and other information that may fall outside its purview.
    • Craft a tailored mediation process accordingly. 

    Mediation

    • Employ a diverse variety of skills such as interpersonal, active listening, articulate communication and styles
      such as facilitative, evaluative, collaborative, etc., tools such as opening statement, caucuses, etc.

    • This helps to establish neutrality, rapport, understanding, trust and confidence in the process; environment conducive to constructive negotiations; and mediator's control over the process.
    • Identify specific issues and interests of each party, develop a discussion strategy, and brainstorm with the parties
      to create and evaluate shared solutions.
    • Guide parties towards having a rational yet amiable conversation where creative and collaborative resolutions can be sought. 

    Post-mediation

    Apply for the execution of the settlement agreement; monitor the progress of the execution of the settlement agreement; and If the matter stays unresolved then ensure to keep the parties involved in the process until all the conceivable options are exhausted. - monitor
